Terms Of Service (Web Hosting)

HOSTING SERVICE TERMS & CONDITIONS

a) The Customer wishes to use the Web Hosting Service as described by the ArtchaStudio.com Service & Pricing information.

b) ArtchaStudio.com has offered to provide the Hosted Service to the Customer in accordance with the terms and conditions outlined in this Agreement. Your use of the ArtchaStudio.com hosting services indicates your agreement to be bound by these terms of service. Any reference in this agreement to you, your, yours is a reference to the Customer. Any reference to we, us, our or ours is a reference to ArtchaStudio.com

1. User Conduct

You agree to abide by all applicable local, state, national and international laws and regulations regarding your use of our service including but not limited to the prevention of hosting of offensive, racist or discriminatory material on your web site.

2. Terms of Payment

You agree to pay the price for ArtchaStudio.com’s services in accordance with the payment terms which is payment is made 1 month in advanced for the web hosting usage. In the event of non-payment occurs by the due date, notification will be sent to you. Your web site will be terminated automatically after 30 days when payment has not been received. We reserves the right to vary the standard prices at any time and will provide 30 days notice of any price alteration. All payments are to be made in Australian currency. ArtchaStudio.com will pass on the cost of bank (and any other online payment service providers) processing fees associated for any payment methods used.

3. Backup of Web Site Content

ArtchaStudio.com provides a full back-ups of data of your web site as a courtesy and it’s conducted once a month . Back-ups are made for server restoration purposes only. You are also responsible for keeping a copy of your most current web site files as backup on your own computer system or other. If any loss of data ( or including entire web site) occurs due to failure of main web server supplier of ArtchaStudio.com, we are not responsible for such occurrence and any lost. However we will assist and resolve the event and use reasonable efforts to recover the data from the most recent backup archive to restore your web site without charges.

4. Uptime Guarantee

ArtchaStudio.com guarantees the service will be available 99.5% of the time in any month. We will credit back 20% of the monthly web hosting charge where we breach this standard. Customers may request such credit within seven (7) days after Network Unavailability. This uptime guarantee does not relate to speed of page delivery, or page loading which may be affected by the customer’s internet connection speed or other factors.

5. Amandement, Termination & Cancellation

ArtchaStudio.com may change this agreement from time to time and a copy will be sent for you to review and sign. You may disagree and terminate this agreement at any time by providing notification within 30 days. Your web site (all contents) will be terminated and deleted in our server. 100% refund of the first web hosting cost will be provided if cancellation occurs within 45 days from the first day of the web site is active online.

6. Governing Law

New South Wales (Australia) law shall govern this Agreement, and any dispute arising from the relationship between the parties to this Agreement, excluding any laws that direct the application of another jurisdiction’s laws.

7. Creation of Web Application Customization

Any modifications of the Joomla or Wordpress (Content Management System Software) or any other open source product made by ArtchaStudio.com on behalf of you personally or your business is performed under contract in the name of your or your business. The intellectual property of these modifications shall be owned by your business but created under the terms of the GNU public license (“GPL”). This entitles the customer to exclusive use of these software modifications for any business purpose including hosting and publication of their web site on the internet without the requirement to release these modifications to any 3rd party.

8. Inclusion of Web site Footer text

ArtchaStudio.com includes footer link on its client web sites. This link helps visitors of your web site to find out more about your web site structure and us as your web service provider. We ensure the information provided is to help increase the prominence of your web site credibility. The footer link can be removed for the cost of $2/month.

9.Level support and help:

Site Maintenance
Instruction and training will be provided to client on how to updating the site content via e-mail, video, or via phone. ArtchaStudio.com is available to update client’s web site on basis service for $1.50/ minutes including graphic design service, file editing and production.

Site Unavailable
Server Maintenance is conducted regularly and schedule time table is provided on our site. Notification is sent to you regarding server down time.

E-mail and Telephone
24 hour response time is assured. In most cases, your support request will actually be responded to within an hour.
